The terms and conditions set out below apply to your purchase of the self-study programme, “The Super Simple Guide To Live Launching” offered by Niki Hutchison Limited. Please read them carefully as they affect your rights and liabilities under law and set out the terms under which I, Niki Hutchison provide services to you, as purchaser of The Super Simple Guide To Live Launching. These terms are subject to any rights you have under consumer law to which I am bound to and which cannot be waived.

Course Outline

The Super Simple Guide To Live Launching is a self-study course. 

The aim is to provide support and guidance on the strategies behind creating a Live launch for your new digital product, online course or 1-2-1 service. The information is not tailored to any specific industry or any one person or business but includes information which has been tested and used across a range of different industries. The course is most useful for entrepreneurs running service-based businesses, rather than product-based business owners or organisations. Course Specifics

Following successful purchase of The Super Simple Guide To Live Launching you will receive access to the 4 pre-recorded modules along with introduction and summary videos and four workbooks.

You will then have the opportunity to work through these modules in your own time. The course provides strategies to help you set intentions for your launch whilst

For best results it is recommended that you undertake each module in order as the strategies are presented in a linear and logical order within the course materials.

Whilst all the strategies have previously been carried out with great success by my clients past and previous as well as in my own business, it is not possible to provide any guarantees that you will experience any specific results. Failure to complete the self-study materials will limit your ability to benefit from the information provided and will significantly limit any results. The course is not bespoke and includes general advice. Should you feel that you need additional support, such as one-to-one or strategic marketing support, that can be provided separately.

Please be aware that the course is delivered entirely in English and no translations are provided for videos or text.

Payment Terms

The cost of the course is set at the time you book. On booking, you will agree to a one-off payment via ThriveCart which will be taken at time of booking and all purchases are final. (Please see below for details about refunds).

Support

The aim for this course is that you should be able to access the course material with ease. Should you require any technical support in respect of accessing the pre-recorded videos then we are happy to help you to get up and running. Please email niki@nikihutchison.com and you will receive a reply between Monday to Friday from 9am until 5pm. We aim to respond to you within 24 hours if you email during those hours. 

Once you have finished going through the course material you may wish to work with me further. I am a Marketing Strategist and Branding Expert championing entrepreneurial women. Privacy

Your privacy and protection of your personal data is important to us. We will keep your personal data confidential and will never share it with unconnected third parties. Your payment information will be processed by a secure third-party processor. We will be provided with your email address and name but will never be provided with your financial information. 

We utilise ThriveCart, ActiveCampaign and Facebook to manage our Payments and communications with you and from time to time we may utilise the Facebook Pixel analytics tool.

Refunds and Cancellation 

As you are purchasing digital content which includes data which is produced and supplied in digital form you are only entitled to a refund in limited circumstances.  In purchasing the course you are waiving your rights to a refund unless the statutory circumstances for refunds are met.

Should you consider that the course videos are faulty for any reason then please confirm so immediately. Please contact niki@nikihutchison.com and we will investigate and make sure that you can access the videos.

Intellectual Property 

intellectual property rights and copyright connected with those materials remain with us, Niki Hutchison Ltd. You have the right to use the materials as learning tools but you are not permitted to duplicate, imitate or provide copies to third parties whether for free or as part of a sale. 

Feedback and Complaints 

If you have any feedback about the course please do share it with me. It is always great to receive words of praise and also helpful to get constructive comments. I really hope that you love this course as much as I do but if you would like to make a complaint this should be made to made in writing to niki@nikihutchison.com.

Your Obligations

You agree to:

Co-operate with us in all matters relating to the Services;

Provide to us in a timely manner all documents, information, items and materials in any form requested by us or otherwise reasonably required by us in connection with the Services and ensure that they are accurate and complete in all material respects;

Behave honestly, professionally, courteously and respectfully in all your dealings with us, our employees, our contractors, our clients, and any other third parties to whom you may be introduced or with whom you may interact in connection with the Services; and

Make your best endeavours to engage with the Services.

You are at all times responsible for your physical, mental and emotional health and wellbeing before, during and after the provision of the Services. If at any time you feel unwilling or unable to continue with the Services due to a risk to your physical, mental or emotional health, you agree to advise us immediately and seek appropriate professional assistance. 

Confidentiality

Each party undertakes that it will not at any time disclose to any person any confidential information concerning the business, affairs, customers, clients, suppliers, personal circumstances, finances or family circumstances of the other party which is shared in written, verbal or visual format, except as may be required by law, a court of competent jurisdiction or any governmental or regulatory authority.

No party shall use any other party’s confidential information for any purpose other than to exercise its rights and perform its obligations under or in connection with this Agreement.

Both parties agree to not take any actions, make any statements, whether oral or in writing, that negatively impact the other party's business, services, products or reputation.

Termination  

Without affecting any other right or remedy available to it, either party may terminate this Agreement with immediate effect by giving written notice to the other party if the other Party commits a material breach of any term of this Agreement.

Without affecting any other rights or remedies available to us, we may terminate this Agreement immediately if you fail to pay any amount due under this Agreement on the due date for payment.

If you choose to terminate this Agreement prior to the end of its agreed term, as set out in Schedule 1 to this Agreement, you acknowledge and agree that you will be liable for the Charges for the entire term as if the Agreement had been completed. For an abundance of caution, you acknowledge and agree that you will still be liable for payment of the agreed Charges for the agreed Services for the full term of the Agreement, regardless of your early termination.

On termination of this Agreement you will immediately pay to us all of our outstanding unpaid invoices and interest and, in respect of Services supplied but for which no invoice has been submitted, we will submit an invoice, which shall be payable by you immediately on receipt.

General

We intend to rely on the written terms set out in these terms and conditions for the services that we provide to you in delivery of the course. These written terms shall constitute the entire agreement between us.

Should there be any conflict between these terms and any subscription hosting platform or payment gateway, these terms shall prevail. 

We may update these terms and conditions from time to time for legal or regulatory reasons or to allow the proper operation of your service. Any changes will be notified to you as soon as possible.

If any provision or part-provision of these terms and conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any such modification or deletion shall not affect the validity and enforceability of the rest of these terms and conditions.

These Terms are governed by the laws of Scotland. The Courts of Scotland have exclusive jurisdiction over any matter and proceedings arising out of the challenge.
