The Visibility Experience Terms & Conditions

Our core ethos for Niki Hutchison Limited (trading as Enjoy Marketing®) is to show you a way of doing business which empowers you and those around you. We practice what we preach and part of that involves setting out clearly from the outset the way in which we will deliver our services to you. If you are planning to join The Visibility Experience, then you must read these terms and conditions in full prior to purchasing.

The Visibility Experience Terms: Key Details

The terms cannot be varied and in proceeding to purchase The Visibility Experience you will be deemed to have accepted these terms. The terms and conditions set out below apply to the services offered by Niki Hutchison Limited (trading as Enjoy Marketing®). Please read them carefully as they affect your rights and liabilities under law and set out the terms under which Niki Hutchison Limited (trading as Enjoy Marketing®) (“we”, “our” or “us”) provide services to you, as purchaser of the services. These terms are subject to any rights you have under consumer law to which we are bound and which cannot be waived by contract.

The Visibility Experience Outline

The Visibility Experience consists of one group pre-planning session, followed by a one-day photo and video shoot session to produce 60 pieces of organic content which you can use to promote your business.

The aim is to provide strategy, video, photography and graphic design specific to your business and which your business can use as content marketing assets.

The Visibility Experience Specifics

The Visibility Experience involves:

1. One group marketing strategy call, held online, for between 90 - 180 minutes.

2. One full day in Edinburgh (usually between 9am - 4pm) spend creating video content and brand photography.

3. Dinner at Gleneagles Town House that evening.

4. Video and photography editing, including captions.

5. Supply of 60 pieces of personalised content for your business, including B Roll videos, Talking Head videos, brand photography and graphic design templates.

Group Marketing Strategy Call & Content Day

The call will be led by Niki Hutchison and will take place on Zoom. The Content Day will be led by Niki Hutchison and the Enjoy Marketing® team of experts and will take place in Edinburgh.

During the live session, you will get input and feedback on your business from Niki Hutchison. 

The information and guidance shared by Niki Hutchison will be based on her educational and career experience. Niki has an MA Honours Degree in Business with Marketing, a PostGraduate Diploma in Advertising and spent most of her career working in brand and advertising strategy, before becoming an entrepreneur and then founding her own marketing agency.

The aim of The Visibility Experience is to provide you with strategic content marketing assets to better grow your business. As a business owner, your business is individual and personal to you and whilst the strategies and assets which I will provide are tested, it is not intended that you will join The Visibility Experience and that you will instantly turn a profit overnight. 

We make no guarantees or claims as to the success of anyone attending The Visibility Experience. Each individual is unique and their business and processes are unique to them. The aim is that by purchasing The Visibility Experience you will become more strategic and will be provided with the content marketing assets required to create a more successful business.

All information and assets provided will be bespoke. We are not responsible for any action or inaction which you take as a result of the information and assets provided within The Visibility Experience. We are not responsible for any loss of opportunity or any investments which you make. 

No content marketing assets provided or advice given within The Visibility Experience should be construed as medical advice, whether mental or physical. If you believe that you require medical attention you should seek assistance from a medical professional immediately. 

Contact and Schedule

Should an unforeseen reason arise which causes any session to be postponed, it will be re-arranged as soon as possible. 

If you have any questions about The Visibility Experience, the Enjoy Marketing® team will be available by email Monday to Friday between 9am to 5pm and will respond as soon as possible and within a maximum of 48 hours during the hours stated but usually much sooner.

Payment Terms

The cost of The Visibility Experience is set at the time you purchase. In order to attend you will agree to either a one-off payment via ThriveCart which will be taken immediately or split payment via ThriveCart, the first payment will be taken immediately and the second and third one and two months later respectively.

Privacy and Confidentiality

Your privacy and the protection of your personal data is important to us. Your personal data is protected as set out in our privacy policy which can be found https://www.nikihutchison.com/privacy-policy.

We utilise ThriveCart and ActiveCampaign to manage our communications with you and from time to time may utilise the Facebook Pixel analytics tool. 

Refunds and Cancellation 

In accordance with Distance Selling Regulations, you have the right to cancel and obtain a full refund within 14 days from the date of payment. Refund requests should be made in writing to niki@nikihutchison.com and a full refund will be provided within 14 working days.

In the event that the group strategy call or email contact have already taken place within the first 14 days following your subscription, you are still entitled to request a refund but the value of the session(s) and advice provided shall be deducted from the amount paid by you, along with any reasonable costs which have been borne by us in respect of the administrative costs of commencing the programme. 

There is no obligation on us to refund any amounts paid where cancellation requests are made following the 14 day cancellation period.

We reserve all rights to cancel the service for any reason without prior notice. In such circumstance a refund will be provided for the remainder of the service as applicable. 

Intellectual Property 

During the service you may be provided with study materials. At all times the intellectual property rights and copyrights connected with those materials remain with us. You have the right to use the materials as learning tools but you are not permitted to duplicate or provide copies to third parties. We retain and reserve all of our copyrights.

Complaints 

If you have a complaint about the service this should be made to made in writing to Niki Hutchison at niki@nikihutchison.com.

Frequently Asked Questions

1. What happens if I can’t attend on the day?

   As The Visibility Experience has limited spaces and involves preparation specific for your business, if you can’t make it on the day for any reason, your booking will be forfeited.

2. Will I have access to the recordings from our sessions?

   No, our sessions will not be recorded for privacy reasons. 

3. What if I need additional support?

   We are happy to provide additional support if required, please contact us directly, additional charges will apply.

4. Is The Visibility Experience suitable for those at all stages of business?

   Yes, I will tailor my advice and the content marketing assets to your specific business and circumstances.

General

We intend to rely on the written terms set out in these terms and conditions for the services that we provide to you in delivery of The Visibility Experience. These written terms shall constitute the entire agreement between us.

Should there be any conflict between these terms and any membership hosting platform or payment gateway, these terms shall prevail. 

We may update these terms and conditions from time to time for legal or regulatory reasons or to allow the proper operation of your service. Any changes will be notified to you as soon as possible.

If any provision or part-provision of these terms and conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any such modification or deletion shall not affect the validity and enforceability of the rest of these terms and conditions.

These Terms are governed by the laws of Scotland. The Courts of Scotland have exclusive jurisdiction over any matter and proceedings arising out of the Membership.
